Main site or location of works, place of delivery or of performance: Kent County Council (KCC) through its Energy Buying Group (LASER), wishes to create a UK wide, national procurement Framework Agreement for the provision of Fixed Term Fixed Price Natural Gas.
KCC will act as the Contracting Authority buying gas on behalf of participating local authorities, public and third sector organisations who are members of those organisations listed below.
The Agreement will be accessible to all members as defined by the EU Combined Procurement Directive 2004/18/EC, Local Authority Councils, Regional Improvement and Efficiency Partnerships (RIEPs), the Police Service, the Fire and Rescue Service, the NHS & NHS Trusts (including the Ambulance Service), Third Sector Organisations, Registered Charities, Registered Social Landlords, Educational Establishments, Academic Centres, Coastguard Emergency Services, publicly funded organisations and publicly owned private companies. Access to this Agreement shall be subject to the agreement of the Contracting Authority.

The Contracting Authority wishes to create a national procurement Framework Agreement and is inviting tenders for the Supply and Delivery of Fixed Term Fixed Price Natural Gas Supplies. It must be noted by tenderers that as all opportunities will be let competitively between those on the Framework Agreement inclusion on the Framework is no guarantee of business.
Tenderers should note that for indicative purposes only the following volumes have been included based on annual historical consumption data.
Total number of FTFP Sites 851, No of MPR 1,120, Volume =266,981,207kWh per annum.

The performance of the contract is subject to particular conditions: yes
Description of particular conditions: The Supplier agrees that there shall be no discrimination by it against any person with respect to opportunity for employment or conditions of employment, because of age, culture, disability, gender, marital status, race, religion or sexual orientation. The Supplier shall in all matters arising in the performance of the Agreement comply with the provisions of the Sex Discrimination Act 1975 and the Disability Discrimination Act 1995 and any regulations made thereunder. The Supplier shall in all matters arising in the performance of this Agreement comply with the provisions of the Employment Equality (Age) Regulations 2006. The Supplier must comply with all the provisions of the Race Relations Act 1976 and the Race Relations (Amendment) Act 2002 and shall ensure that they perform their responsibilities under this Agreement with due regard to the need to eliminate unlawful racial discrimination and to promote equality of opportunity and good relationships between different racial groups. Suppliers must hold a current and appropriate UK Supply Licence as issued by OFGEM.

Information and formalities necessary for evaluating if the requirements are met: Any supplier may be disqualified who:
(a) is bankrupt or is being wound up, where his affairs are being administered by the court, where he has entered into an arrangement with creditors, where he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order compulsory winding up the administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means which the contract authorities can demonstrate;
(e) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information required under this Section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal organization, as defined in Article 2(1) of Council Joint Action 98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in Article 3 of the Council Act of 26 May 1972 and Article 3(1) of Council Joint Action 98/742/JHA3 respectively;
(j) has been the subject of a conviction for fraud within the meaning of Article 1 of the Convention relating to the protection of the financial interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined in Article 1 of Council Directive 91/308/EEC of 10.6.1991 on prevention of the use of the financial system for the purpose of money laundering.
