Scarborough Borough Council is seeking a private sector partner to develop, design and construct new Sports and Leisure Facilities within Scarborough following the Competitive Dialogue Procedure under the Public Contracts Regulations 2006.
The Council is only seeking applications from organisations, partnerships or consortia who can deliver all aspects of the project for which one single 'turnkey' contract will be awarded. Applications are not being sought for individual elements of the project such as consultancy, design only or construction only.
The Council specifically requires the design and construction of a new football ground and a new Leisure Centre on land owned by the contracting authority at Weaponness, Scarborough.
The contracting authority will offer consideration to the successful developer in the form of disposal to the developer of upto 4 parcels of land at Filey Road, Seamer Road, Weaponness and Ryndle Crescent. The developer will be permitted to develop the four land parcels subject to obtaining the necessary statutory consents including planning and environmental. The developer will be required to secure the funding for the design and construction of the new Sports and Leisure Facilities including all professional and related costs, to bear all risks of the development, and to complete the construction to the requirements of the contracting authority, prior to being given the parcels of land. The subsequent development of the four land parcels by the developer does not form part of this contract.
The contracting authority may accept proposals from participants that offer phased solutions, a more limited solution in terms of facilities and price but will also welcome solutions that offer added value extended facilities.

The contracting authority will require collateral warranties. The contracting authority may require a performance bond and/or parent company guarantee.

The Council does not have any capital monies to contribute to the project; the Council’s contribution will be it’s land.
In return for the construction of the facilities the Council will transfer either the freehold or leasehold of its sites at Filey Road, Seamer Road, part of Weaponness and Ryndle Crescent to the Developer for them to redevelop. It is not anticipated that any capital sums or fees will be paid to the developer for the design and construction of the Leisure Village.
In addition, in disposing of its property, section 123 of the Local Government Act 1972 requires the Council to obtain the best consideration that can reasonably be obtained, and therefore the Council reserves the right to withdraw a site(s) or additionally request a capital receipt should there be a substantial imbalance between the cost/value of the completed Leisure Village and the ultimately developed sites (as independently valued).
