Refurbishment of non traditional construction, to 2 high rise blocks of flats (10 storey) and 2 low rise blocks of flats (up to 4 storey) including (but not limited to): Removal of existing claddings, new rainscreen cladding and external wall insulation, enclosed balconies, replacement roofs (flat and pitched), windows, doors, louvres, foyers, drainage and utility spaces.
Works may include provision or replacement of fire detection, fire extinguishing/suppression systems, louvre systems, door entry, telecommunication and digital reception equipment, heating systems, ventilation equipment and renewable technologies.
Works may be required to local environs including hard and soft landscaping, fencing, hedging, tree planting, provision of playground and allotments. The works may include installation artworks, decorative features and visual changes to buildings and grounds.
The purchaser will be seeking to appoint a principal contractor to undertake works "with contractor's design" of parts of the works. The purchaser will require engagement in community activities and positive engagement in resident consultation and participation.
The principal contractor will be required to demonstrate previous experience, capability, skill, capacity and resources to undertake the project.
It is expected that works will require contractor's design and this may encompass novation of certain designers from the Purchaser to the Contractor as necessary to meet the Employer's Requirements.
It is expected that the works will be let under a JCT form of contract.
It is expected that assessment of tenders will be using a price and quality formula and that financial terms will apply including satisfactory financial checks.
Performance monitoring in respect of quality, cost, time management, safety and other criteria may be instigated.
Use of Risk register and Early Warning Process will be required.
A Contract Performance Bond of 10 % of the Contract Value may be required.
A Parent Company Guarantee may be required.
The Authority is seeking to appoint a Principal Contractor to undertake the works.
The Principal Contractor will be expected to design or develop designs for various parts of the project to meet the performance specifications and Employer's requirements. The contract will be "with contractor's design".
The principal Contractor may be required to enter into novation agreements for the acceptance of members of the Authority's design / consultancy team to further or complete the design works.
The works will be executed to provide and warrant a future beneficial life of minimum of 25 years and to meet the requirements of the Non-Traditional Homes Assurance Scheme (NTHAS).
Product Warranties of a minimum of 20 years of the Principal Elements of the Construction Work will be required including for:
— cladding system (including all seals, insulation, cladding panels, fire barriers and support structures),
— roofs,
— windows, doors and screens,
— balconies and support structures.
Latent Defect Warranties may be required.
British Board of Agrement Certificates (or regional equivalent) supporting life expectations of 30 years minimum may be required for the Principal Elements of the Construction Work including for:
— cladding system (including all seals, insulation, cladding panels, fire barriers and support structures),
— roofs,
— windows, doors and screens (frames but not glazing).
Other warranties and assurances may be required and will be set out in the tender documents.

(a) is bankrupt or is being wound up, where his affairs are being administered by the court, where he has entered into an arrangement with creditors, where he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order compulsory winding up the administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;

III.2.3)Technical capacity
Information and formalities necessary for evaluating if the requirements are met:
(a) a list of the works carried out over the past 5 years, accompanied by certificates of satisfactory execution for the most important works. These certificates shall indicate the value, date and site of the works and shall specify whether they were carried out according to the rules of the trade and properly completed. Where appropriate, the competent authority shall submit these certificates to the contracting authority direct;
(b) a list of the principal deliveries effected or the main services provided in the past 3 years, with the sums, dates and recipients, whether public or private, involved. Evidence of delivery and services provided shall be given: - where the recipient was a contracting authority, in the form of certificates issues or countersigned by the competent authority, - where the recipient was a private purchaser, by the purchaser’s certification or, failing this, simply by a declaration by the economic operator;
(c) an indication of the technicians or technical bodies involved, whether or not belonging directly to the economic operator’s undertaking, especially those responsible for quality control and, in the case of public works contracts, those upon whom the contractor can call in order to carry out the work;
(d) a description of the technical facilities and measures used by the supplier or service provider for ensuring quality and the undertaking’s study and research facilities;
(e) where the products or services to be supplied are complex or, exceptionally, are required for a special purpose, a check carried out by the contracting authorities or on their behalf by a competent official body of the country in which the supplier or service provider is established, subject to that body’s agreement, on the production capabilities of the supplier or the technical capacity of the service provider and, if necessary, on the means of study and research which are available to it and the quality control measures it will operate;
(f) the educational and professional qualifications of the service provider or contractor and/or those of the undertaking’s managerial staff and, in particular, those of the person or persons responsible for providing the services or managing the work;
(g) for public works contracts and public services contracts, and only in appropriate cases, and indication of the environmental management measures that the economic operator will be able to apply when performing the contract;
(h) a statement of the average annual manpower of the service provider or contractor and the number of managerial staff for the last 3 years;
(i) a statement of the tools, plant or technical equipment available to the service provider or contractor for carrying out the contracts;
(j) an indication of the proportion of the contract which the services provider intends possibly to subcontract;
(k) with regard to the products to be supplied: (i) samples, descriptions and/or photographs, the authenticity of which must be certified if the contracting authority so request; (ii) certificates drawn up by official quality control institutes or agencies of recognized competence attesting the conformity of products clearly identified by references to specifications or standards.

Precise information on deadline(s) for lodging appeals: After a decision on award has been made the Borough of Poole will as soon as possible inform the tenderers and candidates of its decision and include in this notice the criteria for the award and the reasons for the decision including the name, score, characteristics and (unless the recipient is a candidate) the relative advantages of the successful tenderer and the score of the recipient of the notice plus any other required information. Unless there is any contingency to account for there will normally be a minimum 10 calendar day standstill period.
Unless the information has already been given in the standstill letter or there are legal grounds to withhold information the Borough will supply to any unsuccessful economic operator the reasons why it was unsuccessful and the information described in the previous paragraph within 15 days of a request in writing. Such additional information should be required from the address at I.1 above.
The Public Contracts Regulations 2006 (SI 2006 No. 5) provide for economic operators who consider the Borough has breached its duties to take action in the High Court. Any such action must be brought promptly (generally within 3 months) from the date when the grounds for starting the proceedings first arose. Economic Operators are advised to take legal or other relevant professional advice when considering a legal challenge as the Regulations contain various time limits for starting proceedings. Where a contract has not been entered into and a breach is found to have taken place the Court may make an interim order or order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into and the grounds for such an order are made out the Court may make a declaration of ineffectiveness, must impose penalties and may award damages.
