Justification for a framework agreement, the duration of which exceeds four years: Initially for 3 years but may extend the framework, as it is a restricted market controlled by the all island energy regulator we may extend the framework on an annual basis for a maximum of a further 2 years.

Supply of electricity to Northern Ireland Local Government. The supply of electricity will be open to all local government bodies in Northern Ireland and the successful candidates from this framework will be invited to tender on a mini competition basis (ITQ) as the requirement arises during the validity of this framework. All competitions utilising this framework, must only be undertaken following attaining approval of the procurement group that administered and prepared this tender.

Additional information about electronic auction: An electronic auction maybe used as a method of undertaking the mini competitions following the setup of the framework, although it is not intended for the initial mini competition we wish to reserve the right to use this method in the future.

Precise information on deadline(s) for lodging appeals: The Council will incorporate a minimum 10 calendar day standstill period (Reg 32 Notice) when information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the Council before the contract is entered into. Applicants have 2 working days from notice of the award decision to ask for additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be requested from e-mail address: purchasing.department@newryandmourne.gov.uk.

If a dispute about contract award has not been successfully resolved the Public Contracts Regulations 2006, as amended, allow aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court. Any such action must be brought promptly (generally within 3 months). The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into.
