Conwy County Borough Council seeks to engage a Contractor to undertake the initial phase 1 coastal defence works as part of the Colwyn Bay Waterfront Project. The works shall comprise construction of a rock groyne, a section of rock revetment, sections of wave return walls and retaining walls and modification of existing coastal defence structures. The works shall utilise grant funding provided to Conwy County Borough Council by the European Regional Development Fund with match funding provided by the Welsh Assembly Government.

This contract shall be for construction of the following principal elements, during the 2010/11 financial year:
— A 200m straight rock groyne constructed perpendicular to the existing sea defence wall,
— A length of rock revetment to the east of the new groyne,
— Reinforced concrete retaining walls behind the new revetment,
— A section of reinforced concrete wave return wall on the promenade west of the new groyne,
— Modification work as necessary to the existing sea defence wall.

VI.4.2)Lodging of appeals
Precise information on deadline(s) for lodging appeals: Conwy County Borough Council will incorporate a minimum 15 day standstill period following communication of intent to award the contract to the Tenderers. This period allows unsuccessful Tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the decision to award to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be requested from the contact point in I.1. if an appeal regarding the award of the contract has not been successfully resolved, the United Kingdom's Public Contracts Regulations 2006 (SI 2006 No5) provides for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within three months). Where a contract has not been entered into, the Court may order the setting aside of the award decision or other authority to damages. (The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the Contract is entered into).
