Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC or 2004/17/EC respectively

It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 31(2)(b) of Directive 2004/18/EC (Regulation 14(1)(b)(ii) of UK Public Contracts Regulations 2006). This is because Lockheed Martin UK Insys Limited are the Original Equipment Manufacturer and a change of supplier will result in the contracting authority having to acquire material having different technical characteristics which would result in incompatability with the supplies and installations covered by the original contract together with a disproportionate impact on costs and the logistics to ensure maintenance and continuity of operations. These additional deliveries are intended as a partial replacement of normal supplies or installations. The Contract will be for a period of less than 3 years.
