Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC or 2004/17/EC respectively
The works/goods/services can be provided only by a particular tenderer for reasons that are: connected with the protection of exclusive rights
JBTSE Project Team, part of the UK Ministry of Defence, intends to place a contract amendment to its existing contract with Bohemia Interactive Australia Pty Ltd. This contract provides for the support and maintenance of Virtual Battlespace models used across the UK MOD. The amendment is to complete the Type 45 Destroyer models alongside existing training simulation software to permit further use of the core software to continue the Royal Navy’s training for the class of ships. The duration of the contract amendment will be 6 months.
It is considered that the amendment to this contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Defence and Security Public Contracts Regulations 2011 Regulation 16(1)(a)(ii)). This is for reasons connected to the exclusive design rights in the relevant software belonging to Bohemia Interactive Australia and such services cannot be provided without access to that information.
