III.1)Conditions relating to the contract
III.1.1)Deposits and guarantees required:
Va fi prezentata/depusa pâna la data si ora limita de depunere a ofertelor, in cuantum de 8 700,00 RON, valabila pentru întreaga perioada de valabilitate a ofertei. Suma ce se va retine de catre autoritatea contractanta din garantia de participare, în conditiile prevazute la art. 278^1 din OUG 34/2006 (actualizata) este de 4 245,45 RON.
a) Garantia de buna executie este de 10 % din valoarea fara TVA a fiecarui contract subsecvent si se constituie anexa la contractul subsecvent;
b) Garantia de buna executie se poate constitui:
— printr-un instrument de garantare emis în conditiile legii de o societate bancara sau de o societate de asigurari, care devine anexa la contract,
— prin ordin de plata (cont trezorerie RO57TREZ2315005XXX000377) Trezoreria Constanta,
— prin depunerea în numerar la casieria unitatii a contravalorii acesteia, în situatia în care valoarea acesteia este mai mica sau egala cu 5 000 RON.
c) Garantia de buna executie va fi eliberata/restituita în cel mult 14 zile de la data îndeplinirii de catre contractant a obligatiilor asumate prin fiecare contract subsecvent, daca nu au fost ridicate pâna la aceasta data pretentii asupra acesteia.

Lista a principalelor livrari de produse efectuate în ultimii trei ani, însotita de recomandari/acte constatatoare/alte documente edificatoare din partea beneficiarilor înscrisi în lista principalelor livrari de produse, care sa confirme livrarea produsului carne de porc, în cantitate cumulata de cel putin: 60 000 kg.
Raport de încercare / buletin de analiza care sa ateste sa ateste ca produsul ofertat îndeplineste cerintele minime de calitate impuse în caietul de sarcini.
Standarde de asigurare a calitatii în domeniul la care se încadreaza produsele ce fac obiectul acordului-cadru: certificat ISO 9001/ echivalent, pentru ofertant.

Modul de constituire al garantiei de participare:
1) virament bancar /instrument de garantare emis în conditiile legii de o societate bancara /societate de asigurari,în original, în cuantumul si pentru perioada prevazuta în documentatia de atribuire. Daca se constituie prin instrument de garantare emis de o societate bancara /societate de asigurari, din continut sa reiasa ca acopera si situatia prevazuta de art. 278^1dinOUG34/2006(actualizata).Garantia sa fie irevocabila. Instrumentul de garantare sa prevada plata neconditionata-la prima cerere a beneficiarului, pe baza declaratiei acestuia cu privire la culpa persoanei garantate.

3) depunerea contravalorii acesteia la casieria unitatii, în situatia în care valoarea acesteia este mai mica sau egala cu 5 000 RON. Dovada constituirii garantiei de participare si a documentelor care confirma statutul de IMM al op. ec, (daca este cazul), se va face prin transmiterea în format electronic pe SEAP a acestora si în original la sediul UM 02022- în situatia prevazuta la pct.1, pâna la data si ora limita de depunere a ofertei, specificate în anuntul de participare. În situatia în care ofertantii sunt IMM-uri, în baza art. 16, alin 2 din Legea 346/2004, acestia beneficiaza de reduceri cu 50 % pentru criteriile legate de cifra de afaceri, garantia de participare si garantia de buna executie - anexa1 la Legea 346/2004. În cazul în care se constata ca ofertele clasate pe primul loc au preturi egale, autoritatea contractanta va solicita clarificari prin intermediul SEAP, în vederea încarcarii electronice de catre operatorii economici de documente care contin noi preturi.
