The works/goods/services can be provided only by a particular tenderer for reasons that are: technical
Extreme urgency brought about by events unforeseeable by the contracting entity and in accordance with the strict conditions stated in the Directive: yes
Wynajcie lokomotyw elektrycznych do wykonania pocigowej i pozapocigowej obsugi trakcyjnej pocigów jest niezbdne do realizacji rozkadu jazdy 2011/2012. W przetargu nieograniczonym ogoszonym 27 wrzenia br. nie zoono adnej oferty. Obejmowa on najem lokomotyw w okresie od 15.12.2011 r. do 31.12.2012 r. W kolejnym postpowaniu przeprowadzonym w trybie negocjacji bez ogoszenia (termin realizacji pozosta taki sam jak w przetargu) jedyna oferta, zoona przez PKP CARGO S.A., znaczco przekroczya budet Zamawiajcego o 23 %. Zamawiajcy nie by w stanie zapewni takiej sumy na okres do koca grudnia 2012 r., poniewa wymaga to uzyskania zgód korporacyjnych, co ze wzgldu na krótki czas (termin skadania ofert 1 grudnia, a realizacja od 15 grudnia) nie byo moliwe. Ponadto w zwizku z opracowaniem w ostatnim czasie nowego rozkadu jazdy ulegy zmianie: termin realizacji zamówienia oraz liczba lokomotyw (z 34 do 30) niezbdnych do przewozów. W zwizku z powyszym Zamawiajcy zdecydowa si udzieli przedmiotowego zamówienia na okres 3 miesicy PKP Cargo S.A., tak aby w tym czasie pozosta cz zamówienia (tj. udostpnienie lokomotyw w okresie od 1 kwietnia do 31.12.2012 r.) udzieli wykonawcy wyonionemu w przetargu nieograniczonym. Ponadto z wiedzy, jak dysponuje Zamawiajcy, nie ma na rynku wykonawcy innego ni PKP CARGO S.A., który byby w stanie zrealizowa przedmiotowe zamówienie. Podmioty, które posiadaj lokomotywy, wykorzystuj je do realizacji wasnych zada. Potwierdzaj to wyniki postpowa przetargowych, które corocznie ogasza Zamawiajcy i w których nie zgosi si nigdy nikt poza PKP Cargo S.A. W wietle powyszego zasadnym jest zlecenie przedmiotowego zamówienia w trybie zamówienia z wolnej rki z art. 67 ust. 1 pkt. 1 lit. a) oraz ust. 3 w zwizku z art. 134 ust. 6 ustawy Prawo zamówie publicznych.
