De Opdrachtgever biedt de gelegenheid tot een bezoek aan de locatie aan, te weten woensdag 1.9.2010 aanvang 9.00 uur.

Inschrijvers kunnen zich hiervoor tot dinsdag 31.8.2010, 14.00 uur per e-mail aanbesteding@csg-bv.nl ter attentie van mevrouw C.C.F. van der Blom aanmelden. Per Inschrijver kunnen maximaal 2 personen deelnemen.

Het programma ziet er thans als volgt uit:

VI.4.2)Lodging of appeals
Precise information on deadline(s) for lodging appeals: Een Inschrijver die bezwaar wenst te maken tegen de aanbestedingsprocedure en/of tegen zijn afwijzing laat zich leiden door het belang van het project (ingangsdatum van het contract op 1 januari 2011) en de voortvarendheid waarmee Opdrachtgever de aanbestedingsprocedure wenst te doorlopen. Dit betekent in ieder geval dat als een partij bezwaren heeft tegen (onderdelen van) de aanbestedingsprocedure, tegen (onderdelen van) de verstrekte informatie of tegen andere aspecten, die verband houden met de opdracht of de aanbestedingsprocedure, zij die bezwaren gemotiveerd ter kennis moeten brengen aan Opdrachtgever op de kortst mogelijke termijnen in ieder geval binnen 15 kalenderdagen na verzending van de betreffende informatie.
De termijn waarbinnen een Inschrijver bezwaar moet maken tegen de afwijzing van zijn Inschrijving bedraagt 15 kalenderdagen, te rekenen vanaf de dagtekening van de afwijzing. Een Inschrijver maakt bezwaar door middel van het aanhangig maken van een kort geding. Indien deze termijn wordt overschreden zonder dat een juridische procedure aanhangig is gemaakt, vervalt ieder recht daartoe.
Op deze Aanbestedingsprocedure is Nederlands recht van toepassing.
De (voorzieningen-)rechter van de Rechtbank te 's-Hertogenbosch is bij uitsluiting bevoegd om geschillen te beslechten.
Na ommekomst van de termijn van 15 kalenderdagen zal met de Inschrijver die de hoogste totaal score heeft gekregen een Overeenkomst gesloten worden. Indien een kort geding aanhangig is gemaakt, wordt de Overeenkomst gesloten nadat daarin vonnis is gewezen en het sluiten van de Overeenkomst niet in strijd is met dat vonnis. Opdrachtgever zal ook de uitspraak in een eventueel hoger beroep afwachten dus pas nadien een Overeenkomst sluiten, indien het hoger beroep als 'spoed appèl' wordt aangemerkt.
