Gegadigde verzekeraars dienen in het bezit te zijn van een inschrijving in een beroeps- en handelsregister of een vergelijkbare verklaring of attest als bedoeld in artikel 47 van het Bao, alsmede een vergunning van de AFM voor het uitvoeren van het verzekeringsbedrijf conform de Wet Financieel Toezicht.
