II.1.5) Short description of the contract or purchase(s):
The European Water Framework Directive 2000/60/EC was developed to establish a framework for the protection of inland surface waters, transitional waters, coastal waters and groundwater throughout Europe.
The Environmental Protection Agency would like to set up a framework agreement for the sampling and analysis of groundwater (boreholes and springs) in order to satisfy the monitoring requirements of the Water Framework Directive.
The consultant will primarily be undertaking groundwater sampling and delivering these samples to the EPA for analysis (they should also undertake field parameter analysis and return these results to the EPA). The consultant will also be required to organise analysis for microbiological parameters (and again provide the analysis results for this to the EPA).
Occasionally, the consultant may have to organise analysis for other parameters, including pesticides and organics, as required. Therefore the consultant may have to develop links with other laboratories during the framework period.

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers:
Information and formalities necessary for evaluating if requirements are met: None at this stage, however, tenderers will be required to confirm that none of the conditions for exclusion regarding bankruptcy, payment of taxes, etc apply to their particular case. As part of this confirmation, tenderers will be asked to sign a Declaration of Bona Fides which will be included in the tender documents.
III.2.2) Economic and financial capacity:
Information and formalities necessary for evaluating if requirements are met: In order to be considered for inclusion on the tender list, candidates must provide the following information.
Please submit the following:
(a) A copy of a current bankers reference
(b) Evidence of turnover for the most recent years of operation (most recent 3 years).
(c) Statement of percentage of turnover in relation to employer representative services (approx)
(d) Evidence of current employers, public liability and professional indemnity insurances.
Minimum level(s) of standards possibly required: Candidates should note that the following rules will apply to some of the referenced criteria:
(b) Candidates should provide evidence of annual turnover in excess of 1 000 000 EUR in at least one of the last three financial years of operation. Evidence may be provided by way of audited accounts, a statement from their auditors or otherwise.
(d) Candidates should provide evidence by means of a copy of their insurance certificate(s) or a letter from their broker stating the current levels of insurance for the company.

In order to be considered for inclusion on the tender list, candidates must provide the following information.

(e) Organisation details, including year of establishment, legal personality if any, structure, manpower and management levels and range of services offered. Note, this should include the relationship between the proposed project team and the rest of the organisation.
(f) Details of key personnel in the organisation, including summary CVs, qualifications and relevant experience. Note, this should include CVs on personnel from the proposed project team
(g) Details of previous contracts of a similar nature. This should include contract description, client names and contacts, delivery dates, services provided and contract values.
(h) Details of quality assurance system, if any, in place and whether 3rd party attested.
(i) Information on any subcontractor(s) proposed.

Candidates should note that the following rules will apply to some of the referenced criteria:
(e) and (f) Candidates should demonstrate that they possess adequate resources to manage a contract of this type and scale.
(g) Candidates should provide evidence of the successful delivery of at least three contracts of a similar nature in the recent past.

SECTION IV: PROCEDURE

IV.1) TYPE OF PROCEDURE
IV.1.1) Type of procedure:
Accelerated restricted.
Justification for the choice of accelerated procedure: This contract is a legal requirement that needs to be addressed as it is necessary for Ireland € s implementation of the Water Framework Directive on integrated river basin management for Europe (2000/60/EC). The normal timescales would render the process impracticable for reasons of urgency.
IV.1.2) Limitations on the number of operators who will be invited to tender or to participate:
Envisaged minimum number: 5.
Objective criteria for choosing the limited number of candidates: Upon receipt of expressions of interest, candidates will be evaluated in respect of the financial, economic and technical capacity information and minimum levels stated.
Candidates will be scored and at least the best 5 scoring candidates, depending on the quality and number of applications received, will be invited to tender.

SECTION VI: COMPLEMENTARY INFORMATION

VI.1) THIS IS A RECURRENT PROCUREMENT:
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU FUNDS:
VI.3) ADDITIONAL INFORMATION:
Interested candidates are advised that the award of contract(s) will be on the basis of the Standard Conditions of Engagement for Consultants issued by the Irish Department of Finance.
1) The contracting authorities will not be responsible for any costs, charges or expenses incurred by candidates or tenderers.
2) Contract award will be subject to the approval of the competent authorities.
3) This is the sole call for competition for these services.
4) The contracting authorities reserve the right to award contracts to two or more tenderers under one or two lots.
5) The FOI Act applies to the EPA and to Local Authorities in charge of the River Basin Districts and therefore all candidates should indicate whether any of the information provided by them in the course of this award procedure is to be treated as sensitive commercial information, which should remain confidential.
6) The successful tenderer(s) will be required to furnish a valid tax clearance certificate from the Irish Revenue Commissioners.
7) Contract award may be subject to satisfactory performance at interview.
8) It is the policy of the contracting authorities in accordance with EU procurement rules to publish the value of contracts awarded to successful tenderers in the Official Journal of the EU.
9) The contracting authorities reserve the right not to establish the framework agreement or to award any contract on foot of this procedure. No guarantee regarding the potential volume or value of work under the framework is given. The contracting authorities may elect to cancel this procedure at any time at their sole discretion.

It is intended to establish a framework agreement with multi-party operators for the provision of the required services. Interested parties should download the Expression of Interest Document from www.etenders.gov.ie and return the Qualification Questionnaire by the stated deadline.

Establishment of the Framework Agreement:
The framework will be established by means of a competitive tendering process among selected applicants. This will result in the admittance of at least 3 parties to the framework and to the award of an initial contract. Subsequently, only those admitted to the framework will be entitled to tender for future contracts under the framework.
Operation of Framework Agreement.
Following the evaluation of the applications, a tender list will be drawn up and tenders invited for an initial contract, the results of which will be used to establish the multi-party framework agreement.
€ Applicants are reminded that the successful economic operator appointed to the framework will at all times be required to avoid potential conflict of interest throughout the lifetime of the framework,
€ Admission to the framework may be subject to successful interview and presentation,
€ Admission will also be conditional upon production of a valid tax clearance certificate and prior acceptance by the service provider of the formal terms and conditions of the Awarding Authority,
€ Following on from the establishment of the framework agreement, new contracts will be awarded by mini-competition among the framework members or foot of the original tender offer.
