Il concorrente, singolo, raggruppato o consorziato può fare affidamento sulle capacità di altri operatori economici ricorrendo all’istituto dell’avvalimento di cui all’art. 49 del D.Lgs. 163/06 per i soli requisiti economici.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if requirements are met: Le società interessate devono presentare domanda redatta in lingua italiana corredata da dichiarazione sostitutiva, resa ai sensi dell’art. 38, comma 3 del D.P.R. 445/2000 dalla quale risulti che la società:
a) è iscritta nel Registro delle imprese presso la CCIAA;
b) che non si trova in alcuna delle condizioni di esclusione di cui all’art. 38 del D.Lgs. 163/06;
c) non è soggetta alle misure interdittive di cui all’art. 3, comma 1, del D.Lgs. 369/93, convertito in L. 461/93 (incapacità di contrarre con la PA a seguito di condanna per i delitti previsti dall’art. 32 quater del CP);
d) possiede una organizzazione commerciale e distributiva tale da assicurare una corretta esecuzione della fornitura;
e) è in regola con quanto disposto dall’art. 17 della L. 68/1999.
In caso di RTI i suddetti requisiti dovranno essere posseduti da tutti gli operatori economici coinvolti.

a) l’importo globale delle forniture e l’importo delle forniture nel settore oggetto della gara, realizzati negli ultimi 3 esercizi (2007-2008-2009) art. 41 punto 1 lettera c) del D.Lgs. 163/06;
b) l’elenco delle principali forniture effettuate durante gli ultimi 3 esercizi, (2007-2008-2009) con il rispettivo importo, data e destinatario – art. 42, punto 1, lettera a) del D.Lgs. 163/06.
