Justification for the award of the contract without prior publication of a contract notice in the Official Journal of the European Union (OJEU):
Directive 2004/18/EC

1) Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC

— atteso che CRI e CTT ritengono indispensabili e imprescindibili i servizi di assistenza tecnica, di tipo full risks, con interventi tecnici tempestivi in caso di guasto o malfunzionamento sulla strumentazione, per garantirne un regolare funzionamento e la conseguente continuità dei servizi di analisi erogati, interni ed esterni,
— richiamata la fattispecie di cui all’art. 57 comma 2, lett. b del D.Lgs. n. 163/2006 secondo cui è possibile procedere a procedura negoziata senza previa pubblicazione di bando qualora, per ragioni di natura tecnica o artistica ovvero attinenti alla tutela di diritti esclusivi, il contratto possa essere affidato unicamente ad un operatore economico determinato,
— considerato che la complessa tecnologia costruttiva e i delicati meccanismi di funzionamento e di settaggio degli strumenti di spettrometria di massa e cromatografia, gas e liquida, possono essere oggetto di manutenzione e assistenza tecnica, on site, esclusivamente a cura dell’impresa produttrice della strumentazione e cioè con intervento dei tecnici specializzati Waters,
— dato altresì atto che, con riferimento all’Italia ed al Trentino-Suedtirol, l’esclusività territoriale per l’espletamento dei servizi è riconosciuta a Waters SpA (società con sede legale in Italia – in Vimodrone (MI), facente parte del gruppo Waters Corporation con sede in Milford-MA-USA) (dichiarazione di esclusività Waters d.d. 4.8.2011),
— accertata pertanto la fondatezza giuridica dell’affidamento dei servizi di assistenza e manutenzione mediante procedura negoziata senza previa pubblicazione del bando in quanto le caratteristiche tecniche delle prestazioni contrattuali affidate, integrano, come sopra illustrato, la fattispecie giustificativa di cui al citato articolo 57 c. 2, lett. b), del codice dei contratti pubblici,
— rilevato come, per le medesime motivazioni e peculiarità tecniche suesposte, in particolare in ragione dell’esclusività nel possesso del necessario know how tecnologico per intervenire su strumentazioni tecniche di elevata complessità costruttiva e delicati meccanismi di setting e funzionamento, non possa darsi applicazione al comma 6 dell’art. 57 secondo il quale la stazione appaltante è chiamata, a interpellare per la procedura di negoziazione dell’offerta almeno 3 operatori economici se esistenti,
— ritenuto pertanto, conclusivamente, di contrattare i servizi in parola mediante procedura negoziata senza bando con la sola Waters SpA, con sede in Vimodrone (MI).
