Le tipologie specifiche delle seguenti cauzioni e garanzie saranno indicate nella lettera d’invito: garanzia provvisoria a garanzia dell’offerta; garanzia definitiva a garanzia dell’esecuzione del contratto; polizza assicurativa RCT; polizza infortuni.

Information and formalities necessary for evaluating if the requirements are met: La richiesta di partecipazione a gara (redatta in lingua italiana) dovrà dimostrare, mediante dichiarazione sostitutiva resa ai sensi del D.P.R. 28.12.2000, n. 445, con richiamo esplicito alle sanzioni penali previste all’art. 76 per le ipotesi di falsità in atti e dichiarazioni mendaci e con allegata fotocopia di un documento di identità del firmatario:
a) di non essere soggetto ad una delle cause di esclusione previste dall’art. 38, comma 1. e comma 2., del D.Lgs. 163/2006;
b) essere una società di capitali in possesso dei requisiti di cui all’ 285, del D.P.R. 207/2010.

La presente procedura è stata autorizzata con atto n. 1488 del 5.12.2011. La domanda dovrà essere spedita con la dicitura: “Non aprire – domanda di partecipazione gara C–5”. Codice identificativo di gara: CIG 3868477036. Responsabile unico del procedimento è il capo del servizio amministrativo.
L’Amministrazione Difesa potrà, con provvedimento motivato, sospendere, non procedere all’aggiudicazione della gara ovvero alla stipula del relativo contratto ove sopravvengano motivi di opportunità e/o di pubblico interesse o venga a mancare la necessaria copertura finanziaria, senza ricorrere in richiesta danni, indennità o compensi da parte dei concorrenti e/o aggiudicatario, anche in deroga agli artt. 1337 e 1338 C.C.

L’amministrazione si riserva altresì di non aggiudicare e/o stipulare il contratto qualora la Consip SpA attivi una convenzione relativa alle prestazioni oggetto della presente procedura (D.M. 17.2.2009 MEF). Richiedente Stato membro UE può fornire le prove richieste secondo i propri ordinamenti, in conformità agli articoli 38 (comma 5), 39 (comma 2), 43 e 45 del D.Lgs. 163/2006. Verifiche come da articoli 38 (commi 3 e 4), 42 (comma 4), 46 e 48 del D.Lgs. 163/2006. Tutte le comunicazioni e tutti gli scambi di informazioni tra stazione appaltante e operatori economici possono avvenire solo mediante fax confermato a mezzo posta raccomandata con avviso di ricevimento (art. 77 – comma 7, lett. a) e b) del D.Lgs. 163/2006. È disponibile un apposito modulo di domanda sul sito http:\\www.esercito.difesa.it alla sezione “Bandi di gara”. Per eventuali problemi di collegamento al sito internet, è possibile richiedere informazioni al n. +39 0647357188 ovvero tramite posta elettronica all'indirizzo amministrazione@esercito.difesa.it. In aderenza a quanto previsto dall’art. 26 del D.Lgs. n. 81/2008, per l’esecuzione della fornitura in argomento non si prevede la predisposizione del documento unico di valutazione dei rischi da interferenza (DUVRI). La stima dei costi relativi alla sicurezza è da considerarsi di importo pari a 0. In conformità a quanto stabilito dall’art. 241, comma 1-bis del D.Lgs. 163/2006, l’aggiudicatario, entro 20 giorni dalla conoscenza dell’aggiudicazione, ha la facoltà di ricusare la clausola compromissoria (arbitrato) prevista nel capitolato. In tale evenienza non sarà possibile ricorrere successivamente al compromesso.
