L’Azienda servizi municipalizzati, in esecuzione della deliberazione del Consiglio di amministrazione n. 77 del 29.6.2010, indice una procedura di gara aperta, ai sensi dell’art. 55 del decreto legislativo 12.4.2006, n. 163, per l’aggiudicazione dell’appalto relativo alla fornitura biennale di gasolio per autotrazione.

III.1)CONDITIONS RELATING TO THE CONTRACT

III.1.1)Deposits and guarantees required

— L’offerta dei concorrenti deve essere corredata da una cauzione provvisoria di 7 280 EUR, pari al 2 % dell’importo complessivo relativo alla durata dell’appalto costituita con le modalità e nel rispetto delle prescrizioni di cui all’art. 75 del D.Lgs. 12.4.2006, n. 163. L’importo della garanzia è ridotto del 50 % per gli operatori economici in possesso delle certificazione di cui al comma 7 dell’articolo sopracitato,
— L’offerta deve essere altresì corredata, a pena di esclusione, dell’impegno di un fideiussore a rilasciare garanzia fidejussoria per l’esecuzione del contratto, qualora l’offerente risultasse aggiudicatario,
— Ai sensi dell’art. 8 del disciplinare di gara e in attuazione del disposto di cui dall’art. 113 del D.Lgs. 12.4.2006, n. 163, l’aggiudicatario deve contrarre una polizza fidejussoria a favore dell’Azienda servizi municipalizzati di Molfetta con soggetti abilitati a costituire cauzioni a favore di pubbliche amministrazioni, con cui prestare cauzione definitiva per un importo pari al 10 % dell’importo di aggiudicazione. Detta percentuale sarà soggetta ad incremento ove ricorrano gli estremi di cui all'art. 113, 1° comma, D.Lgs. 12.4.2006 n. 163.

I pagamenti saranno effettuati con le modalità previste dall’art. 18 del capitolato speciale d’appalto ed in conformità alle disposizioni di legge ed alle norme regolamentari in materia di contabilità aziendale.

Si procederà alla individuazione, verifica ed eventuale esclusione delle offerte anormalmente basse ai sensi degli art. 86, 87 ed 88 del D.Lgs. 12.4.2006, n. 163. Congiuntamente all’offerta dovranno essere presentate le giustificazioni di cui agli articoli sopraccitati.
Si procederà all’aggiudicazione anche in presenza di una sola offerta valida ex art. 55, comma 4, ed art. 81, del D.Lgs. 12.4.2006, n. 163 (previsione facoltativa per la Stazione Appaltante).
