III.1)CONDITIONS RELATING TO THE CONTRACT

III.1.1)Deposits and guarantees required

Cauzione o fideiussione a titolo di garanzia come previsto dall’articolo 75 del decreto legislativo 12.4.2006, n. 163. Tale garanzia prevede espressamente la rinuncia al beneficio della preventiva escussione del debitore principale, la rinuncia all'eccezione di cui all'articolo 1957, comma 2, del codice civile (garanzia prestata a semplice richiesta scritta della Stazione Appaltante), nonché una validità di almeno duecentoquaranta (240) giorni dalla data di presentazione dell'offerta. Il valore della garanzia deve essere pari al 2 % dell’importo di spesa complessivo previsto (contrattuale) per fornitura del lotto/di ciascuno dei lotti, come previsto dall’articolo 75, comma 1, del decreto legislativo 12.4.2006, n. 163; tale importo potrà essere ridotto del 50 % per gli operatori economici ai quali venga rilasciata, da organismi accreditati, ai sensi delle norme europee della serie UNI CEI EN ISO/IEC 17000, la certificazione del sistema di qualità conforme alle norme europee della serie UNI CEI ISO 9000; su questo documento, o su documento a parte, dovrà essere presentato l'impegno di un fideiussore a rilasciare la garanzia fideiussoria per l'esecuzione del contratto qualora il concorrente risultasse affidatario (articolo 75, comma 8, del decreto legislativo 12.4.2006, n. 163).

Information and formalities necessary for evaluating if requirements are met: — non trovarsi nelle condizioni di esclusione previste dall’articolo 38, comma 1, del decreto legislativo 12.4.2006 n. 163 (requisiti di ordine generale),
— essere in regola con gli obblighi sanciti dall’art. 17 della legge 12.3.1999, n. 68,
— gli estremi dell’iscrizione alla Camera di commercio, industria, artigianato e agricoltura e, nel caso di società, nel Registro delle imprese presso il Tribunale, ovvero per le società straniere in Registro equivalente,
— essere/non essere in una situazione di controllo, ai sensi dell’articolo 2359 del codice civile e di aver formulato autonomamente offerta,
— offerta è corredata dall'impegno (allegata fisicamente nella busta 1) di un fideiussore a rilasciare la garanzia fideiussoria per l'esecuzione del contratto qualora l'offerente risultasse affidatario (articolo 75, comma 8, del decreto legislativo 12.4.2006, n. 163),
— aver tenuto conto nella preparazione dell’offerta degli obblighi in materia di sicurezza, di condizioni di lavoro e di assistenza in vigore nel luogo dove deve essere eseguita la fornitura,
— aver preso visione e di accettare il regolamento di gara, il capitolato speciale, il capitolato tecnico, le condizioni contrattuali e di essere consapevole di tutte le circostanze generali e particolari che possono influire sulla determinazione dell’offerta.

Information and formalities necessary for evaluating if requirements are met: — aver realizzato, negli ultimi 3 esercizi chiusi (2007/2008/2009), un fatturato complessivamente non inferiore al valore contrattuale presunto (60 mesi) della fornitura di ciascuno dei lotti per cui si partecipa, ossia 225 000 EUR per il lotto 1 e 50 000 EUR per il lotto 2,
— aver corredato la presente dichiarazione di una dichiarazione, relativa alla dimostrazione della capacità finanziaria ed economica della società, rilasciata da almeno 2 istituti bancari o intermediari autorizzati ai sensi del decreto legislativo 1.9.1993, n. 385.
