La ASL BA si riserva la facoltà: di non far luogo alla gara; di sospenderla o prorogarne la data di svolgimento; di non procedere all’aggiudicazione o di non aggiudicare uno dei lotti. Il subappalto è consentito nei limiti ed alle condizioni di cui all’art. 118 D.Lgs. 163/06. In tal caso è fatto obbligo all’affidatario di trasmettere entro 20 giorni dalla data di ciascun pagamento effettuato nei suoi confronti, copia delle fatture quietanzate relative ai pagamenti da esso affidatario corrisposti al subappaltatore, con indicazione delle ritenute di garanzia effettuate.
