Justification for a framework agreement, the duration of which exceeds four years: Ce marché passé selon l'article 30-I du CMP est un MBC dont la durée est fixée à 1 an renouvelable 6 fois. Donc d'une durée de 7 ans. Cette durée est justifiée par l'objet du marché (article 77-II du CMP). L'agence compte mener à bien, sur un site particulier (forêt régionale de Rougeau), une opération de fouilles archéologiques, dont la durée (période préparatoire comprise) peut aller jusqu'à 7 ans. En effet, le calendrier d'une opération de fouilles programmées est fondé sur des campagnes annuelles dont le résultat scientifique détermine la poursuite de l'opération. Les services de l'état (SRA) sont compétents pour autoriser la poursuite d'une opération au vu de ce résultat annuel. La durée réelle finale de l'opération dépend donc des résultats de chaque campagne de fouilles. Le potentiel archéologique de la forêt de Rougeau (évalué à partir d'investigations de 2006 et 2007) indique que la durée d'une fouille programmée (période préparatoire comprise) pourrait dépasser les 4 années et aller jusqu'à 7 ans. Le prestataire (objet de cette consultation) a vocation à encadrer et mettre en oeuvre l'opération de fouilles programmées tout au long de sa durée. Il sera, vis-à-vis des services de l'Etat (SRA, CIRA), le titulaire de l'autorisation préfectorale de fouilles qu'il sollicitera pour cette opération. Son maintien sur cette opération tout au long de sa durée est pour l'état à la fois un gage de continuité et une condition importante pour l'attribution de l'autorisation de fouiller.
