III.1.1)Deposits and guarantees required:

Une retenue de garantie égale à 5 % du montant initial des travaux, augmenté le cas échéant du montant des avenants, sera prélevée par fractions sur chaque versement autre qu’une avance, dans les conditions de l’article 101 du code des marchés publics.
Le remboursement de la retenue de garantie se fait dans les conditions décrites par l’article 103 du code des marchés publics.

III.1.2)Main financing conditions and payment arrangements and/or reference to the relevant provisions governing them:

Le financement est assuré par autofinancement. Il n’est pas prévu d’acomptes pour l’approvisionnement. Le paiement des sommes dues se fera dans un délai global de paiement de 30 jours à compter de la date de réception des factures à la Communauté de communes des Pieux, 31 route de Flamanville, BP 21 - 50340 Les Pieux, FRANCE.
Le défaut de paiement dans ce délai fait courir, de plein droit et sans autre formalité préalable, des intérêts moratoires dans les conditions prévues par le décret n° 2002-232 du 21.2.2002 modifié.
Une avance sera accordée au titulaire si le montant initial du marché est supérieur à 50 000 EUR HT et dans la mesure où le délai d'exécution est supérieur à 2 mois.
Le remboursement de l’avance se fera conformément aux conditions décrites par les articles 88 à 90 du Code des marchés publics.
Le titulaire peut cependant refuser le versement de l’avance dans son acte d’engagement.
