(i) El contenido del Pliego de Condiciones Generales que rige la presente licitación no está adecuado a las últimas modificaciones introducidas por la normativa en materia de contratación pública y, en particular, al Real Decreto Legislativo 3/2011, de 3 de noviembre, que aprueba el Texto Refundido de la Ley de Contratos del Sector Público. Por ello, prevalecerá este último en aquellos extremos relativos a la preparación y adjudicación del contrato en los que (i) existieran contradicciones entre ambos y (ii) resulte de preceptiva aplicación el contenido del referido Texto Refundido.
(ii) La adjudicación y formalización de los contratos derivados del presente contrato, se entenderán realizadas, a los efectos de lo previsto en el artículo 198 del Real Decreto Legislativo 3/2011, de 3 de noviembre, que aprueba el Texto Refundido de la Ley de Contratos del Sector Público, con la mera expedición por Itelazpi de la solicitud al contratista de los correspondientes pedidos de suministro o servicios.
(iii) El presente contrato incluye, además del suministro de equipos multiplexores, los servicios de operaciones de reajuste de canales.
(iv) En relación con el apartado II.3 ha de declararse que, la duración del contrato o fecha límite de ejecución es hasta el 31.12.2014, con la posibilidad de prorrogarlo por 1 año más por mutuo acuerdo de las partes, esto es, hasta el 31.12.2015.
