Der Auftraggeber errichtet auf seinem Gelände in Köln-Riehl den Neubau eines Altenpflegeheimes (Gebäude 39). Das Gebäude ist teilunterkellert, wobei sich im Untergeschoss die Personal-, Abstell- und Technikräume befinden und die Büros, Tagesräume und die Bewohnerzimmer auf drei Etagen (EG, 1. OG und 2. OG) aufgeteilt sind. Gegenstand der Ausschreibung sind die Fernmeldetechnikarbeiten für den Neubau des Altenpflegeheims Gebäude 39 auf dem Gelände der SBK in Köln-Riehl.

VI.4.2)Lodging of appeals
Precise information on deadline(s) for lodging appeals: Eine wirksame Zuschlagserteilung ist erst möglich, wenn der Auftraggeber die unterlegenen Bieter über den Grund der vorgesehenen Nichtberücksichtigung ihres Angebots und den Namen des Bieters, dessen Angebot angenommen werden soll, in Textform informiert hat und seit der Absendung der Information 15 Kalendertage (bei Versand per Telefax oder auf elektronischem Weg: 10 Kalendertage) vergangen sind.
Ein Nachprüfungsantrag ist unzulässig, soweit.
— der Bieter den gerügten Vergaberechtsverstoß schon im Vergabeverfahren erkannt und gegenüber dem Auftraggeber nicht unverzüglich, also ohne schuldhaftes Zögern (i.d.R. innerhalb weniger Tage) gerügt hat,
