Gegenstand des Vergabeverfahrens ist eine Rahmenvereinbarung zum Zwecke der Festlegung von Bedingungen für Einzelaufträge zum Kauf von Getreide über einen Zeitraum von ca. 3 Jahren. Die Vereinbarung tritt mit Zuschlagserteilung in Kraft und läuft bis zum 31.3.2015.

Auf der 1. Stufe findet keine Losaufteilung statt. Eine Losaufteilung erfolgt erst auf der 2. Stufe im Rahmen der Vergabe der Einzelaufträge.
Die Vereinbarung tritt mit Zuschlagserteilung in Kraft und läuft bis zum 31.3.2015.

Information and formalities necessary for evaluating if the requirements are met: — Der Bieter hat seine Zuverlässigkeit nachzuweisen. Hierzu ist mit dem Angebot eine Eigenerklärung gemäß § 6 EG Abs. 6 VOL/A (Anlage 4 der Vergabe- und Vertragsunterlagen) vorzulegen, die u.a. beinhaltet, dass der Bieter sich nicht in einem Insolvenz- oder vergleichbaren gesetzlichen Verfahren befindet und seine Verpflichtung zur Zahlung von Steuern und Abgaben sowie der Beiträge zur gesetzlichen Sozialversicherung ordnungsgemäß erfüllt hat,
— Mit dem Angebot sind geeignete Unterlagen vorzulegen, aus denen hervorgeht, dass der Bieter die erforderliche Qualifikation besitzt und in der Lage ist, die ausgeschriebenen Leistungen nach Art und Umfang durchzuführen (beispielsweise durch Vorlage eines Handelsregisterauszuges). Ausländische Anbieter können statt des Registerauszuges gleichwertige Bescheinigungen von Gerichts- oder Verwaltungsbehörden des Herkunftslandes vorlegen. Registerauszüge dürfen nicht älter als 9 Monate sein,
— Ab einem Auftragswert von 30 000,00 EUR wird die Vergabestelle beim Bundesamt für Justiz von Amts wegen einen Auszug aus dem Gewerbezentralregister (gem. § 150a Abs. 1 Nr. 4 GewO) anfordern und bei der Eignung entsprechend bewerten. Diese Abforderung erfolgt nur bei Bietern, die für eine Zuschlagsentscheidung in Frage kommen.

Handelt es sich bei dem Bieter um eine Bietergemeinschaft, so sind die Eigenerklärungen hinsichtlich der Zuverlässigkeit (siehe Eigenerklärung gemäß § 6 EG Abs. 6 VOL/A) für alle beteiligten Partner zu machen. Nachweise, die die fachliche Eignung betreffen, sind mindestens von demjenigen Teil der Bietergemeinschaft zu erbringen, der mit der Erbringung der (Teil-) Leistung betraut ist, für welche die jeweils geforderte fachliche Eignung relevant ist. Eine Darlegung der einzelnen Zuständigkeiten ist dem Angebot beizufügen. Angebote von Bietergemeinschaften und anderen gemeinschaftlichen Bietern finden nur Berücksichtigung, wenn sie im Angebot jeweils die Mitglieder sowie eines ihrer Mitglieder als bevollmächtigten Vertreter für den Abschluss und die Durchführung des Vertrages benennen. Außerdem müssen sich die Mitglieder der Bietergemeinschaft für alle im Zusammenhang mit dem Vertrag entstehenden Verbindlichkeiten zur gesamtschuldnerischen Haftung verpflichten. Eine nachträgliche Bildung einer Bietergemeinschaft oder Veränderung ihrer Zusammensetzung wird nicht zugelassen. Sofern beabsichtigt wird, Bietergemeinschaften zu bilden, ist das Formular „Erklärung zur Gründung einer Bietergemeinschaft“ auf www.ble.de/zv vollständig auszufüllen und dem Angebot beizufügen!

Bei vorsätzlich unzutreffenden Erklärungen wird von der Möglichkeit des Ausschlusses gemäß § 6 EG Abs. 6 Buchst. e VOL/A Gebrauch gemacht.

Precise information on deadline(s) for lodging appeals: Behauptete Verstöße gegen Vergabebestimmungen, die auf Grund dieser Bekanntmachung erkennbar sind, sind spätestens bis zum Schlusstermin für den Eingang der Angebote gegenüber der Zentralen Vergabestelle (siehe Anhang A) zu rügen (§107 Abs. 3 Ziffer 2 GWB).
Sollte ein Nachprüfungsantrag gestellt werden, muss dieser gem. § 107 Abs. 3 Ziffer 4 GWB innerhalb von 15 Kalendertagen nach Eingang der Mitteilung der Zentralen Vergabestelle, dass diese der Rüge nicht abhelfen wird, bei der Vergabekammer des Bundes beim Bundeskartellamt eingereicht werden.
