c) der aktuellen Marktpositionierung.
— Jeder Einzelbieter hat die Legitimation desjenigen / derjenigen, der / die das Angebot unterzeichnet /unterzeichnen, nachzuweisen. a) über den Gesamtumsatz seines Unternehmens;
b) Soweit der Gesamtumsatz nicht mit dem Umsatz bzgl. des Leistungsgegenstands identisch ist, zusätzlich eine Erklärung über den Umsatz bezüglich der ausgeschriebenen Leistung;
c) über die Anzahl der Beschäftigten in seinem Unternehmen i.S.v. § 267 Abs. 5 HGB;

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: Etwaige Verstöße gegen Vergabevorschriften im Rahmen dieser Bekanntmachung oder der Vergabeunterlagen sind unverzüglich nach Kenntnisnahme (spätestens 14 Tage nach Erhalt der Unterlagen) und im Falle des Nichterkennens aber Erkennenkönnens spätestens bis zum Ablauf der Angebotsfrist gegenüber dem Auftraggeber per E-Mail bei der o.a. Kontaktstelle zu rügen. Ebenso sind sonstige Verstöße gegen Vergabevorschriften von Bewerbern ab Kenntnisnahme unverzüglich gegenüber dem Auftraggeber per E-Mail bei bei der o.a. Kontaktstelle zu rügen.
Nach Ablauf der Angebotsfrist soll eine Rüge nur noch von dem in der Verfahrensvollmacht Bevollmächtigten vorgenommen werden.
Der Auftraggeber weist ausdrücklich darauf hin, dass Rügen abweichend von der vom Auftraggeber bevorzugten Erhebung per E-Mail und durch den in der Verfahrensvollmacht Bevollmächtigten nach den gesetzlichen Regelungen auch auf anderem Wege und durch andere Personen erhoben werden dürfen; in jedem Fall liegt es im Interesse eines Bieters, die Rüge in Schriftform anzubringen und die Berechtigung des Absenders eindeutig nachzuweisen.
Hilft der Auftraggeber dem gerügten Verstoß gegen Vergabevorschriften nicht ab, darf der Bieter einen Antrag auf Einleitung eines vergaberechtlichen Nachprüfungsverfahrens nur innerhalb von 15 Tagen seit Erhalt der Benachrichtigung über die Nichtabhilfe stellen. Eine spätere Anrufung der Vergabekammer aufgrund des gerügten Verstoßes gegen Vergabevorschriften ist gemäß § 107 GWB ausgeschlossen.
