7. Contract description:
The aim of the contract is to support the Ministry of Planning, Budget and Management (MPOG) in Brazil with implementation of the project to support sector-based dialogues between the EU and Brazil. The aim of the project is to facilitate and support exchanges between the relevant EU and Brazilian partners involved in sector-based dialogues covering various thematic fields: social inclusion/cohesion, regional development/planning, environment/sustainable development, education and culture, science and technology, energy, transport, etc. The priority thematic fields will be defined in more detail in the contract's reference clauses.
The service provider must provide specialist consultancy services and logistics support in the following fields: (1) project management and administration; (2) preparation of technical studies in the different relevant thematic areas; (3) high-level technical advice to the institutional partners involved in the dialogues; (4) organisation of conferences, seminars, assignments and other events planned under the project. The service provider must provide a team of consultants, speakers and experts in various specialist fields relevant to the project, for a minimum total of 60 man-months, as well as guarantee the organisation of various events and assignments to be held/carried out in Brazil and in the EU in accordance with requests already made by the MPOG, via the Delegation of the European Union in Brazil.
8. Number and titles of the lots:
The contract is divided into lots: no, 1 lot only.
9. Budget:
Maximum budget: 3 300 000 EUR.
10. Any additional services:
The contracting authority may, at its own discretion, extend the duration and/or scope of the project, subject to availability of funds, provided that said extension does not exceed the initial contract's duration and value. Contract extension is subject to satisfactory performance by the contractor.


Conditions for participation

11. Eligibility:
Participation is open to all legal entities (whether they participate individually or in a grouping (consortium) of candidates) from an EU Member State or from countries or territories of the regions covered and/or authorised by specific instruments applicable to the programme under which the contract is financed (see also point 29 below). Participation is also open to international organisations. Participation of natural persons is directly governed by the specific instruments applicable to the programme by virtue of which the contract is being financed.
Is this project financed by the geographic programmes of the DCI instrument, before 25.3.2012, for 1 or more of the following countries: Afghanistan, Bangladesh, Bhutan, Cambodia, China, India, Democratic People's Republic of Korea, Laos, Malaysia, Maldives, Mongolia, Myanmar, Nepal, Pakistan, the Philippines, Sri Lanka, Thailand and Vietnam?
Yes.
If yes, in addition, Australia is granted reciprocal access to this project.
12. Application:
All natural persons and legal entities who are eligible (see point 11 above) or groupings of said parties (consortia) may submit an application.
A consortium may be a permanent grouping with legal status or an informal grouping created for a specific invitation to tender. All the members of the consortium (i.e. lead company and all other members) are to be jointly and severally liable vis-à-vis the contracting authority.
Should an ineligible natural person or legal entity take part (see point 11), said party will be automatically disqualified. If the ineligible party belongs to a consortium, the consortium in its entirety will be disqualified.
13. Number of applications:
Natural persons or legal entities (whether individual legal entities, lead partners or members of a candidate consortium) can only submit 1 application, irrespective of the form their participation may take. Should a natural person or legal entity submit more than 1 application, all the applications in which said party has participated will be automatically disqualified.
14. Prohibition on alliances between shortlisted candidates:
Any tenders received from tenderers comprising firms other than those mentioned in the application forms used to compile the shortlist will be disqualified from this restricted invitation to tender. Shortlisted candidates may not form alliances or subcontract to each other for the contract in question.
15. Grounds for exclusion:
As part of the application form, candidates must submit a signed declaration, included in the standard application form, stating that they are not in any of the exclusion situations listed in section 2.3.3 of the 'Practical Guide to contract procedures for EU external actions'.
16. Subcontracting:
Subcontracting is permitted.
Maximum percentage of the contract value which may be subcontracted: 35 %.
Activities which may be subcontracted: subcontracting to third parties will only be permitted for logistics services relating to the organisation of conferences, seminars, assignments and other events.
17. Number of candidates to be shortlisted:
Depending on the applications received, between 4 and 8 candidates will be invited to submit detailed tenders for this contract. If the number of eligible candidates (i.e. meeting the selection criteria) is less than the minimum of 4, the contracting authority may invite those candidates complying with the criteria to tender.

Selection and award criteria

21. Selection criteria:
Identical criteria for natural persons and legal entities.
Candidates must comply with the following selection criteria. In the case of applications submitted by a consortium, the selection criteria will be applied to the consortium as a whole:
1) Candidate's economic and financial capacity:
should the candidate be a public body, equivalent information must be provided:
(a) the average annual turnover of the candidate over the past 2 financial years (2008 and 2009) must be at least equal to the maximum contract budget indicated in point 9 above;
(b) the average of cash and cash equivalents at the beginning of the last 2 financial years (2008 and 2009) and at the end of 2008 must have been positive.
2) Candidate's professional capacity:
(a) relevant specialisation in: (i) organisation of conferences, seminars and high-level international assignments; (ii) preparation of technical studies in the thematic fields connected with this project (namely those mentioned in point 7 above); and (iii) high-level technical consultancy for government institutions;
(b) at least 5 members of the candidate's permanent staff must work at present in fields connected with this contract;
(c) at least 10 % of all those persons working for the candidate in 2009 in fields connected with this contract must be permanent staff.
3) Candidate's technical capacity:
1. the candidate must have made a minimum contribution of 30 % to the performance of at least 2 international technical assistance contracts in fields related to this contract with a budget of at least that of this contract over the past 2 years.
An economic operator may, if necessary and for a specific contract, make use of the capacities of other entities, irrespective of the legal relationship it has with them. It must in that case prove to the contracting authority that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal. Said entities, for example the parent company of the economic operator, must respect the same rules of eligibility, and notably that of nationality, as the economic operator.
If more than 8 eligible candidates meet the selection criteria, then the strengths and weaknesses of the applications from these candidates must be re-examined in order to identify the 8 best applications for the invitation to tender. The only factors which will be taken into consideration during this re-examination are:
(1) candidate's experience in organising high-level events in Brazil and within the European Union, in preparing technical studies and in providing technical consultancy to government institutions;
(2) number of candidate's permanent staff currently working in fields connected with this contract;
(3) total value of contracts performed mainly by the candidate in 2008 and 2009 in fields connected with this contract.
