Information and formalities necessary for evaluating if requirements are met: — S’il emploie du personnel assujetti à la loi du 27.6.1969 révisant l'arrêté loi du 28.12.1944 concernant la sécurité sociale des travailleurs, l’attestation de l'ONSS visée à l’article 43bis § 1 de l’arrêté royal du 8.1.1996 relatif aux marchés publics de travaux, de fournitures et de services et aux concessions de travaux publics,
— Le soumissionnaire étranger joindra une attestation délivrée par l’autorité compétente certifiant que, suivant compte arrêté au plus tard la veille de la date limite de réception des offres, il est en règle à cette date avec les obligations relatives au paiement des cotisations de sécurité sociale selon les dispositions légales du pays où il est établi. Lorsqu’un tel document n’est pas délivré dans le pays concerné, il peut être remplacé par une déclaration sous serment ou une déclaration solennelle faite devant une autorité judiciaire ou administrative, un notaire ou un organisme professionnel de ce pays,
— Une attestation contributions directes (formulaire 276 C2) délivrée par le service public fédéral finances (secteur Contributions directes) ou équivalent pour le soumissionnaire étranger,
— Une attestation TVA délivrée par le service public fédéral finances (secteur TVA) ou équivalent pour le soumissionnaire étranger.
Par ailleurs l’article 43 § 1 de l'AR du 8.1.1996 exclut de l’accès au marché à quelque stade que ce soit de la procédure le fournisseur qui a fait l’objet d’un jugement ayant force de chose jugée dont le Pouvoir adjudicateur a connaissance pour:
1° participation à une organisation criminelle telle que définie à l’article 324 bis du code pénal;
2° corruption, telle que définie à l’article 246 du code pénal;
3° fraude au sens de l’article 1er de la convention relative à la protection des intérêts financiers des Communautés européennes, approuvées par la loi du 17.2.2002;
4° blanchiment de capitaux tel que défini à l’article 3 de la loi du 11.1.1993 relative à la prévention de l’utilisation du système financier aux fins du blanchissement de capitaux et du financement du terrorisme.
