Information and formalities necessary for evaluating if the requirements are met: a. Les pièces à fournir dans le cadre des critères d’exclusion (art. 69 de l’AR 1).
(1) Déclaration sur l'honneur implicite.
Par le seul fait de participer à la procédure de passation d'un marché public et de signer son offre (Ann A - rubrique 11), le candidat ou soumissionnaire atteste sur l’honneur qu'il ne se trouve pas dans un des cas d'exclusion visés aux articles 69, § 1er, 1°, 69, § 1er, 2 °, 69, § 1er, 3°, 69, § 1er, 4°, 69, § 2, 1°, 69, § 2, 2 °, 69, § 2, 3°, 69, § 2, 4°, 69, § 2, 5°, 69, § 2, 6° de l’AR1.
(2) Vérification de la situation personnelle par le pouvoir adjudicateur
Le pouvoir adjudicateur vérifie l'exactitude de la déclaration sur l'honneur implicite dans le chef du soumissionnaire dont l'offre est la mieux classée:
— Pour les soumissionnaires belges, en demandant ces renseignements par des moyens électroniques à leurs services gestionnaires, dans la mesure où ils lui sont accessibles gratuitement. Dans le cas contraire, il demande au soumissionnaire concerné de fournir par les moyens les plus rapides, et dans le délai qu'il détermine, les renseignements ou documents permettant de vérifier sa situation personnelle et ceci avant l’attribution du marché,
— Pour les soumissionnaires étrangers, il demande au soumissionnaire concerné de fournir par les moyens les plus rapides, et dans le délai qu'il détermine, les documents, attestations ou certificats délivrés par l’autorité compétente de son pays, et ce avant toute décision relative à l'attribution du marché. Lorsque ces documents ne sont pas délivrés dans le pays concerné, ils peuvent être remplacés par une déclaration sous serment ou solennelle faite devant une autorité reconnue de ce pays (judiciaire, administrative, notaire ou organisme qualifié).
(3) Conséquences de la vérification.
Un candidat ou un soumissionnaire pourra être exclu de la participation au marché s'il apparaît, à la suite de ces vérifications, que la déclaration sur l'honneur implicite ne correspondait pas à sa situation personnelle à la date limite de réception des demandes de participation en procédure restreinte ou négociée avec publicité ou à la date limite de réception des offres en procédure ouverte, aucune régularisation a posteriori n'étant possible.
Une telle exclusion pourra également avoir lieu s'il apparaît que la situation personnelle du candidat ou du soumissionnaire durant le déroulement de la procédure ne correspond plus à la déclaration sur l'honneur implicite.

Le pouvoir adjudicateur entend obtenir les références suivantes: permis d’exploitation.
Le soumissionnaire prouvera par ce document avoir reçu, de la région où est situé son siège social, l’autorisation d’exploiter un service de taxi.
Le soumissionnaire fournira également tout document prouvant qu’il a l’autorisation d’effectuer des missions de services de taxi (départ – arrivée) en région bruxelloise et à Zaventem.
