De gevoerde aanbestedingsprocedure is niet conform de bestaande regelgeving. Met name het Besluit van de Vlaamse Regering d.d. 17.12.1999 betreffende de toegang tot de grondafhandelingsmarkt op de Vlaamse regionale luchthavens werd niet gerespecteerd. Dit besluit is niet verplicht van toepassing voor de Luchthaven Antwerpen, aangezien de vereiste trafiekcijfers niet gehaald worden, doch is de aanbestedende overheid van mening dat een aantal bepalingen in dit besluit toegepast moeten worden, opdat de level playing field tussen de Vlaamse regionale luchthavens onderling maximaal gerespecteerd wordt. Een beperking van het aantal grondafhandelaars zal vastgesteld worden vooraleer een nieuwe procedure gelanceerd wordt, zodat de potentiële dienstverleners een volledige zekerheid krijgen betreffende het aantal toekomstige concurrenten.
De opdracht wordt stopgezet.
